("hatch health", the "Company", "we", "our", or "us") is committed to protecting your privacy and personal information while using our website (www.joinhatch.co) (the "Website"), engaging with our team, and other content, services, product, and functionality offered on or through our services (collectively, the "Services").
This Privacy Policy (the "Policy") governs the manner in which Hatch Health collects, uses, maintains and discloses information collected when you use our Website and Services.

As noted in our Terms of Service, we do not offer medical services or advice, nor do we provide any additional services to healthcare providers beyond matching users with providers. As such, we are not subject to the Health Insurance Portability and Accountability Act (HIPAA) and are not considered a Covered Entity or Business Associate as defined under HIPAA.

Before engaging with this Website, our Services, or submitting any personal information to Hatch Health, please review this Policy carefully. If you have any questions, comments, or concerns about this Policy, please send us an email at privacy@joinhatch.co with the subject "Privacy Policy". By using the Services, you accept the terms of this Privacy Policy and our Terms of Service, confirm that you are at least 18 years of age, and consent to our collection use, disclosure, and retention of your information as described in this Policy.

This Policy describes our practices for information that we collect:
1. Through your engagement of the Services
2. Your communications with us through text, voice calling, video chats, emails, connecting with us on social media
3. Your responses to our advertisements or participation in our surveys, contests, or promotions

What Information We Collect
To ensure that we can offer, secure, enhance, and advertise our Services, we collect the following information from you when you use our Services.

Personal Information. The information we collect is directly from you, at your discretion, when you request for or use our Services, subscribe for a membership, sign up for the newsletter, fill out a form, respond to marketing surveys or communication, engage with us through social media or email, or enter information on our Website.  When using the Services, you may be asked to provide your first and last name, cell phone number, email address, details about where you are in your maternal health journey, delivery date, care needs, or other details relevant to your user experience. We also may collect your payment information for subscription fees and other Services, as well as your marketing preferences. We verify credentials for all doulas and providers within our network. This information may be collected by an authorized third-party vendor on behalf of Hatch Health.

Payment Information.
When you subscribe to Hatch Health Services or request care that involves paying a provider or third party, we may ask for payment information, such as credit card details, expiration date, and billing address. We use Stripe, a trusted payment processor, to securely store your payment information. Stripe may provide us with some limited details, like the last four digits of your card number, the country of issuance, and the expiration date. Rest assured that Stripe handles your payment information in accordance with Stripe's Privacy Policy.

Information disclosed by you. You may voluntarily disclose information to us when you use the Services. For example, when you request to be matched to certain providers or Services, you may voluntarily provide information to your Hatch Health Navigator that is needed to execute your match, such as the stage of your maternal health journey, the care you are seeking, your insurance carrier or budget, preferences, geographical location, or other details you feel necessary.

Communications with Hatch Health Navigators. To gain insight into your maternal health goals, care requirements, preferences, and priorities, as well as to help you locate the necessary support, we keep track of your interactions with your Hatch Health Navigator. This includes any conversations that take place within apps we use, such as chat messages, voice and video calls, SMS messages, as well as any images, videos, or other media that you share with your Hatch Health Navigator. If you ask your Hatch Health Navigator to contact any of our network providers on your behalf, we will also document those interactions. This information is utilized to personalize our Services to your specific needs, and to train your support team to provide more efficient assistance.

Cookies and other monitoring services.  We use various monitoring technologies, such as cookies, web beacons, and pixel tags, collectively referred to as "cookies," to provide, improve, protect, and promote our Services. Cookies help us remember your preferences, understand how you use our Services, and improve them based on that information. We may also work with third-party service providers, such as payment processors, who use cookies and similar technologies when you use our Services or when you visit other websites, apps, or receive emails from them. You can find out more information about how cookies and other monitoring technologies work, as well as how to control them in the Cookie Policy section below.

Device information. We gather information about the devices you use to access our Services, which includes identifying details such as IP addresses, browser type, operating system, language settings, and device type.

Location information. We may use your IP address to determine your location and provide our Services accordingly. This helps us ensure that our Services are available in your area.

Third-Parties. We may receive information about you from other sources, such as our partners in joint marketing campaigns, providers of leads, and vendors who help us prevent fraud and manage risks.

How We Use Your Information
We may use the information we collect from you for the following purposes:

To provide and personalize our support and Services. To customize your maternal health experience and fulfill our obligations to you, we use the information that you provide. For example, we may use the details about your care journey and budget to find a provider that meets your needs and preferences. We also analyze your information to make our Services better suited to your individual needs. This includes personalizing the content and features you may see, training our Hatch Health Navigators and Virtual Doulas to provide more effective support, and refining our business to handle requests more efficiently.

To ensure our Services are functioning properly. We may use your information, such as Services feedback, to identify, understand, and resolve issues.

To communicate with you. We use your information to communicate, provide customer service, and respond to your messages and inquiries. We also use your information to reach out to you regarding your use of our Services. For instance, your Hatch Health Navigator may send you messages or notifications to update you on the progress of your care requests. Additionally, we may contact you to inform you about changes to your account, like upcoming subscription renewals, cancellations, or confirmation of payment.

To market our Services. From time to time, we may inform you about updates, improvements, and promotions that are relevant to our Services and might be of interest to you. We may send you these messages using different methods, such as email, notifications within our products, or push notifications. For information on how to set or modify your communication preferences, please refer to the "Your preferences and privacy rights" section below.

To meet legal obligations. Our Services are subject to specific laws and regulations that may require us to process your information. For instance, we may process your information to fulfill our obligations to third parties, establish, exercise, or defend legal claims, or respond to requests from law enforcement.

To support business goals and objectives. We may use your information for our legitimate business purposes, including analyzing and planning our operations, conducting audits and reporting, and making predictions for future business performance.

To fulfill your requests. We may also use your information for other purposes for which you have given prior consent.

Who We May Share Your Information With
We may disclose your information to the following third-party partners to offer, secure, enhance, and advertise our Services:

Service providers. We may disclose your information with third-party service providers working on behalf of Hatch Health to do things like provide member support, IT services, and payment processing.

Hatch Health Network providers and third-part merchants. To facilitate your care requests, we may disclose your information to third-party service providers, known as the "Hatch Health Network", or merchants. For instance, if you require a birth doula, your Hatch Health Navigator may share your details with a Hatch Health Network provider who can provide birth support in your home or birthing center, is available during your due-date, and fits within your budget. Similarly, if you request your Hatch Health Navigator to enroll you in a childbirth class, we will share your information with third-party merchants to fulfill your request. Please note that we will only share your data to assist with the Services you have requested, and we will limit the sharing to what is necessary. Additionally, the third-party Hatch Health Network provider or merchant's handling of your information will be governed by their own terms and privacy policy.

Other Services users. To facilitate transparency and enable informed decision-making, we may share feedback you provide about a Hatch Health Network Provider or Hatch Health Navigator with other users of the Services. Additionally, we may share aggregated data on user activity to help others understand usage trends.

Advertising partners. To provide you with more relevant ads and promotional messages related to our Services, we collaborate with advertising partners. These ads may include interest-based advertising, contextual advertising, and generic advertising that appear on other websites or services. In this process, we may analyze and share certain information with our advertising partners to assess the effectiveness of our own advertising and deliver ads that align with your interests or preferences.

Legal and public interest reasons. In certain rare circumstances, we may disclose your information to third parties if we determine that such disclosure is reasonably necessary to: (a) comply with a legal obligation imposed by applicable law or respond to valid legal process or government request; (b) protect against the risk of death or serious bodily harm to any person; (c) prevent fraud or abuse of the Hatch Health platform, the Services, or other members; (d) safeguard Hatch Health's rights, property, safety, or interest; or (e) perform a task that is carried out in the public interest.

Corporate transaction. We may share your information with third parties during a corporate transaction, such as a merger or sale of our company. We'll keep your information confidential and give you notice before it's shared or becomes subject to a different privacy policy.

With your consent. We may share your information with third parties if you have given us your explicit consent to do so.

With your employer, healthcare provider, or payer. We may share your information with your employer, healthcare provider, or payer if you sign up for Hatch Health Services as a benefit or perk through them. This includes your name, email address, and aggregated information about your usage of the Services. However, we will not disclose any specific information regarding your care requests or preferences. This sharing enables your employer, provider, or payer to understand how users are utilizing the Hatch Health Services through a sponsored or subsidized program.

We may use your information to create de-identified or aggregated data, which we may share for any legal purpose. This allows Hatch Health Network providers, Hatch Health business partners, and academic researchers to gain insight into general trends about our Services and users.

Retention and Removal of Your Information
We will keep the information you have provided until you ask us to delete it. However, we may still retain some information for legal compliance, fraud prevention, investigation assistance, dispute resolution, agreement enforcement, or legitimate business purposes.

Children's Online Privacy Protection Act
The Services are not intended for use by children under the age of 13. We do not knowingly collect personal information from children under 13 years of age. If we become aware that we have collected personal information from a child under the age of 13, we will promptly take steps to delete that information. If you believe that we may have collected personal information from a child under 13, please contact us at privacy@joinhatch.co. Parents or legal guardians of children under 13 may use the Services on behalf of their children, but they must provide any personal information of their children in compliance with this Privacy Policy.

Your Preferences and Privacy Rights
We offer you the option to manage how you receive various types of communications from us:

Email marketing. To stop receiving marketing emails from us, simply click on the "unsubscribe" link at the bottom of each marketing email, or inform your Hatch Health Navigator that you would like to opt out of such emails. Please note that you cannot opt out of emails related to our Services, such as information about your subscription, care requests, changes to your account, updates to our Terms or Privacy Policy, and technical and security notices.

SMS (text) messages. If you provide your mobile phone number to use our Services, you agree to receive transactional, informational, and account-related text messages from us. You are responsible for any messaging and data charges that may apply. If you want to stop receiving text messages from us, you can contact us directly at privacy@joinhatch.co.

Cookies. If you want to disable the use of cookies, you can adjust your browser settings. However, please be aware that this may affect your ability to use our Services. At the moment, our systems do not respond to Do Not Track (DNT) signals from browsers, as there is no universally agreed upon standard for interpreting them. Please note that cookie-based opt-outs are not effective on mobile apps. However, you can opt out of personalized ads on some mobile apps by following instructions for Android, iOS, and other platforms. For more information on how to control cookies, please refer to our Cookie Policy below.

Interest-based marketing. You can visit the Google Ad Settings page to opt out of Google Analytics for Display Advertising or customize Google Display Network ads. However, please note that even if you choose to opt out, you may still see advertisements from us, but they will be less relevant to you.


If you are a "data subject" to whom the processing of personal information is subject to the REGULATION (EU) 2016/679 (GDPR) ("Covered Person"), you have the following rights: 


Right to access, rectify, erasure, and restriction of processing. You have the right to access the personal information we have stored about you by contacting us. We take appropriate measures to ensure that your personal information is accurate and up-to-date for the purposes for which it was collected. If your personal information is inaccurate or incomplete, you can request that we correct it. If there is no legitimate business purpose or statutory storage obligation, you can request that we delete or restrict the processing of your personal information.

Right to take your information elsewhere. To receive your personal information that you provided to us in a format that can be easily read by machines, or to transmit this information to another controller, please contact us.

Right to object. You have the right to object to the processing of your personal information on grounds related to your particular situation. To do so, contact us. However, we may have compelling legitimate reasons to continue processing your information for reasons other than direct marketing, such as providing access to our Services. You can limit information capture and usage by using ad-blocking software. Contact us if you have questions or wish to make a removal request, but please note that we cannot guarantee that we will honor all requests.

Right to withdraw your consent. You have the right to withdraw your consent to the collection or processing of your personal information at any time. If you choose to withdraw your consent, it will not affect the lawfulness of processing based on consent before its withdrawal. To withdraw your consent, please contact us in writing.

Note that we have 30 days to respond to you and may require additional information to verify your identity or deny your request if we're unable to do so.

Extra Provisions for California and Vermont Residents
The following provisions are applicable to residents of California or Vermont and serve as an addendum to our Privacy Policy.

California and Vermont Residents. We will not disclose any information we gather about you to our affiliates or third parties (including both financial and non-financial entities), except as mandated or allowed by the law in your state.

California Privacy Rights. If you are a California resident, you have the right under California law to request and obtain from us a list, once per year and free of charge, of any third parties to whom we may have disclosed your personal information for direct marketing purposes during the previous calendar year, along with the categories of personal information disclosed. To make such a request, please email us at privacy@joinhatch.co. We do not disclose personal information to third parties for their own direct marketing purposes without obtaining your prior consent. Therefore, you can choose not to provide your consent to prevent the disclosure of your personal information to such third parties for their direct marketing purposes.

Effective January 1, 2020, the California Consumer Privacy Act (CCPA) permits California residents to make a verifiable consumer request to access, obtain, and receive a portable and easily accessible format of their personal information that has been collected by businesses, including the specific pieces and categories of personal information, the sources of the information, the business or commercial purposes for collecting the information, and the categories of third parties with which the information was shared. Additionally, California residents may request the deletion of their personal information under certain circumstances. As per California law, exercising these rights will not result in any differences in service quality or pricing. To initiate a request, please email privacy@joinhatch.co. Please note that identity verification is necessary before any action can be taken, and government-issued identification may be required. If you prefer, you can appoint an authorized agent to make a request on your behalf, and you must provide a valid power of attorney, the requestor's valid government-issued identification, and the authorized agent's valid government-issued identification in order to do so, in accordance with California law.

Selling Your Information
We do not sell, trade, or rent personal identification information to third parties. However, we do permit third parties to gather personal information through our platform and exchange it with other parties for business purposes, which may include advertising and marketing based on users' online activities across different devices and services.

Third Party Websites and Services
Users may find advertising or other content on our Website that link to the sites and services of our partners, suppliers, advertisers, sponsors, licensors and other third parties. We do not control the content or links that appear on these sites and are not responsible for the practices employed by websites linked to or from our Website. In addition, these sites or services, including their content and links, may be constantly changing. These sites and services may have their own privacy policies and customer service policies. Browsing and interaction on any other website, including websites which have a link to our Website, is subject to that website's own terms and policies.

Remarketing
Hatch Health uses the remarketing services to advertise on third party websites (including Google) to previous visitors to our site. It could mean that we advertise to previous visitors who haven't completed a task on our Website, for example using the contact form to make a request. This could be in the form of an advertisement on the Google search results page, or a site in the Google Display Network. Third-party vendors, including Google, use cookies to serve ads based on someone's past visits. Of course, any data collected will be used in accordance with our own Policy and Google's Privacy Policy.

You can set preferences for how Google advertises to you using the Google Ad Settings page , and if you want to, you can opt out of interest-based advertising entirely by cookie settings or permanently using a browser plugin.

Security
We have established reasonable physical, technical, and organizational measures to protect your Personal Data from unauthorized access, use, modification, loss, or theft. However, it is important to note that no system is entirely secure, and we cannot provide a 100% guarantee of the security of our systems.

Cookie Policy
To enrich and perfect your online experience, Hatch Health uses "Cookies", similar technologies and services provided by others to display personalized content, appropriate advertising and store your preferences on your computer.

What Are Cookies? Cookies are small files that are stored on browsers or devices to help websites, mobile apps, and service providers remember information about you. Other technologies, such as pixel tags, web beacons, local storage, and advertising identifiers, serve the same purpose. For simplicity, we refer to all these technologies as "Cookies".

How does Hatch Health Use Cookies?  Hatch Health uses Cookies to help us identify and track visitors, their usage of www.joinhatch.co, and their website access preferences. Hatch Health visitors who do not wish to have Cookies placed on their computers should set their browsers to refuse Cookies before using Hatch Health's Websites, with the drawback that certain features of our websites may not function properly without the aid of Cookies. By continuing to navigate our Website without changing your Cookie settings, you hereby acknowledge and agree to Hatch Health's use of Cookies.

Changes to This Privacy Policy
Although most changes are likely to be minor, Hatch Health may change its Privacy Policy from time to time, and in the Company's sole discretion. Hatch Health encourages visitors to frequently check this page for any changes to its Privacy Policy. Your Acceptance of These Terms
